BuyerView Terms of Service

About BuyerView
BuyerView is a property question and answer platform operated by COSTAPPLE PTY LTD (ABN 15 673 435 491). Buyers ask questions about properties they are considering; verified real estate agents answer them publicly, once, for everyone.

1. Accepting These Terms
By creating an account or using BuyerView, you agree to these Terms of Service. If you do not agree, please do not use the platform.
Who can use BuyerView:
- You must be at least 18 years old. We ask for your date of birth at signup to confirm this.
- You must provide accurate information when signing up.
- BuyerView is offered to residents of Australia and covers Australian residential property.
- You must comply with Australian law.
We may update these terms from time to time. We will notify you of significant changes by email or on the platform. Continued use after changes means you accept the updated terms.
2. How BuyerView Works
For Property Buyers
Your workspace. Signed-in buyers get a private workspace to track properties, keep a due-diligence checklist, store documents, and prepare questions. Your workspace is private to you and, if you invite one, your partner (see section 6).
Two ways to ask a question:
- Post to the public pool. Public posting requires a verified on-site check-in at the property: either a GPS check while you are there, or scanning the agent's inspection QR code at an open inspection. A verified check-in lets you post publicly about that property for 14 days.
- Send privately to the agent. You can always send a question to the listing agent from your own email or messages. Private questions do not require a check-in and are labelled unverified. You are the sender; we do not send messages on your behalf.
Suggested questions. BuyerView can generate suggested questions about a property using artificial intelligence, based on the listing details, photos or documents you provide. Suggestions are prompts for your own due diligence, not statements of fact and not legal, financial or property advice. If you post a suggested question, it becomes your content and you are responsible for it.
Publishing:
- Every public question passes automated moderation before publication. Content that is flagged is held for human review.
- Published questions appear on the property's page with your chosen display name. Your email address is never shown.
- The listing agent chooses whether to answer. We do not guarantee an answer.
- Published questions cannot be edited. If you need something corrected or removed, contact us at legal@mail.buyerview.ai.
- If you close your account, published questions may be retained in de-identified form as part of the property's record (see the Privacy Policy).
For Real Estate Agents
Verification:
- You must hold a current Australian real estate licence or agent's representative registration.
- You supply your licence details; our team reviews them against publicly available licensing register information before your account is verified. This is a human review and usually takes up to 2 business days.
- We may re-verify your licence periodically and may suspend verification if your licence lapses.
Answering questions:
- You choose which questions to answer; you are not obliged to answer any.
- Answers pass moderation before publication and are published with your name and agency.
- One claimed listing per property address. Claiming a listing does not verify you as the appointed agent for the sale; it identifies you as the answering agent on BuyerView.
- You may generate inspection QR codes for your claimed listings, upload listing photos, and share property documents with buyers who have verified their attendance at the property.
- Photos and documents you upload for a listing: you confirm you hold the rights to share them, and you grant us the licence in section 5 to display them on the platform.
Dispute process: if you believe a published question is defamatory or otherwise breaches these terms, email disputes@mail.buyerview.ai. We assess flagged content promptly (usually within 2 business days), may remove or require revision of content, and offer one right of appeal. See section 9.
3. Content Moderation
All public content (questions and answers) passes automated moderation before publication. Flagged content is held for human review.
We may reject or remove content that:
- contains defamatory statements or unsubstantiated accusations;
- includes personal attacks, harassment or offensive language;
- reveals private information about any person;
- is off-topic, spam or advertising;
- violates any law.
Moderation uses: automated screening (including AI services), human review of flagged content, and reports from users. Automated moderation is not perfect; if you believe a decision was wrong, contact us and a person will review it.
4. Your Responsibilities
You agree to:
- provide accurate information;
- keep your account secure and not share your password;
- only post publicly about properties you have genuinely attended;
- be truthful in everything you post;
- comply with Australian law.
You must not:
- create fake accounts or impersonate anyone;
- post false or misleading content;
- harass, defame or threaten anyone;
- attempt to falsify a location check-in or otherwise bypass our verification systems;
- scrape or collect platform data without permission;
- use the platform for any illegal purpose.
If you violate these terms we may remove your content, suspend or terminate your account, and report serious violations to authorities. You remain liable for damage you cause.
5. Intellectual Property
Your content. You own the questions, answers, photos, notes and documents you submit. By submitting content for publication you grant COSTAPPLE PTY LTD a worldwide, non-exclusive, royalty-free licence to host, display and distribute it on the platform. For published public content, this licence continues in de-identified form if you close your account. Content in your private workspace (notes, checklists, private documents) is hosted only to provide the service to you and your invited partner.
AI-generated suggestions are provided as part of the service. When you adopt or post a suggestion, it is treated as your content.
Our content. BuyerView owns the platform's design, code and branding. "BuyerView" and our logo are our trade marks. You may not copy, modify or distribute the platform without permission.
6. Privacy, Workspace Sharing and Location
Privacy. Our Privacy Policy explains in full what we collect and how we handle it, including your rights of access, correction and deletion. Contact for privacy matters: privacy@mail.buyerview.ai.
Workspace sharing. If you invite a partner to your workspace, they can see and edit everything in it: tracked properties, checklists, questions, private notes and documents you have uploaded. Only invite someone you are genuinely house-hunting with. The workspace owner can remove the partner at any time; contributions made before removal remain.
Location verification. To post publicly, we verify you attended the property:
- With your permission, we read your device's GPS position and compare it to the property's location on our server. The distance allowed varies by property type (roughly 25 to 150 metres).
- Alternatively, scanning the agent's inspection QR code at the property records your attendance without GPS.
- We record the result of each verification attempt, including the coordinates at that moment, as part of the verification record. We use this only to operate the check-in system and prevent fraud; we do not track your movements. Retention details are in the Privacy Policy.
- You can decline location access; you can still send questions privately to the agent.
7. Documents
- Your documents (for example a Section 32 you received, or a building report you commissioned) can be stored against a property in your workspace. They are visible only to you and your invited partner.
- Agent-shared documents (for example a vendor statement the agent uploads for a listing) become downloadable to a buyer only after that buyer has a verified on-site check-in at the property.
- Do not upload documents you have no right to share. Copyright in professional reports usually belongs to their author; sharing a commissioned report may breach its licence terms. You are responsible for what you upload.
8. Liability and Disclaimers
We are a platform, not advisers.
- We do not verify the accuracy of questions or agent answers.
- We do not provide legal, financial, conveyancing or property advice. AI-generated question suggestions are due-diligence prompts, not advice.
- We do not endorse any property, agent or transaction.
- Agent verification confirms licence details against public register information at the time of review; it is not a guarantee of the agent's conduct.
Your decisions are yours. Always obtain professional advice (conveyancer, building inspector, lender) before purchasing property, and verify all information independently.
Limitation of liability. To the maximum extent permitted by law, we are not liable for indirect, consequential or special damages, and our total liability is limited to the amount you paid us (if any) in the past 12 months. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for breach of a consumer guarantee can be limited, it is limited to resupplying the service.
9. Disputes and Resolution
Between you and BuyerView
- Email disputes@mail.buyerview.ai first. We aim to resolve complaints within 14 days.
- If unresolved, you can contact Consumer Affairs Victoria (consumer.vic.gov.au).
Governing law: these terms are governed by the laws of Victoria, Australia, and disputes are subject to the jurisdiction of Victorian courts.
About published content
- Anyone may flag content they believe is defamatory, false or in breach of these terms: disputes@mail.buyerview.ai.
- We assess promptly (usually within 2 business days) and may leave, require revision of, annotate, or remove the content.
- One appeal of our decision is available. We are not arbitrators of factual disputes about a property; seek independent advice.
10. Account Closure and Termination
You can close your account at any time by emailing privacy@mail.buyerview.ai. We process closure requests within 30 days. Published public questions may remain in de-identified form; your workspace content is deleted. Details in the Privacy Policy.
We can suspend or terminate accounts that breach these terms (including false content, harassment, fake accounts, attempts to falsify verification, or illegal activity). If we terminate your account we will notify you by email, and you may appeal within 14 days.
11. Third-Party Services
We rely on service providers to operate the platform, including Supabase (database and authentication), Netlify (hosting), Resend (email), Google (maps, address search, sign-in and analytics), OpenAI (content moderation), Anthropic (question generation) and Hugging Face (text processing). Their processing of data on our behalf is described in the Privacy Policy. Links to external websites are provided for convenience; we do not control or endorse them.
12. Agent-Specific Terms
- Keep your licence current; we may re-verify periodically.
- Ensure answers are truthful and not misleading, and comply with your professional conduct obligations.
- Disclose conflicts of interest (for example, if you own the property).
- Do not answer on behalf of other agents without authorisation, post fake questions or answers, or use the platform to advertise unrelated services.
- Agent accounts are currently free. We will give at least 30 days notice before introducing any paid features.
13. Changes to the Service
We may introduce new features, verification methods or paid tiers over time. The core flow for buyers (asking questions about a property) is free today; if that ever changes we will give at least 30 days notice. We will notify you of significant changes to these terms or the service.
14. Definitions
- "BuyerView", "we", "us", "our": COSTAPPLE PTY LTD trading as BuyerView.
- "You", "your": users of the platform (buyers or agents).
- "Property": residential real estate in Australia.
- "Check-in": a server-verified record that you attended a property (GPS or agent QR code).
- "Question": content submitted by a buyer about a property.
- "Answer": a response from a verified agent.
- "Workspace": a buyer's private area for tracking properties, shared with at most one invited partner.
15. General
- Entire agreement: these terms plus the Privacy Policy are the complete agreement between us.
- Severability: if any part is invalid, the rest remains in force.
- No waiver: not enforcing a term does not waive our right to enforce it later.
- Assignment: you cannot transfer your rights under these terms; we may assign them if the business is sold, with notice to you.
- Force majeure: we are not liable for failures caused by events beyond our reasonable control.
